1.Who we are

BecArt FuturePath (the “Service”, “App”, “we”, “us”) is operated by BECART DIGITAL SOLUTIONS, a British Columbia sole proprietorship (BC Registry No. FM1112039, Canada Business Number 703278838BC0001) owned and operated by Arthur Okeoghene Ajatuaewo, offering the BecArt FuturePath service, based in British Columbia, Canada. By creating an account or otherwise using the Service you (“you”, the “Parent”) agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, do not use the Service.

2.What the Service is — and is not

BecArt FuturePath is an exploration tool. It helps parents notice and reflect on patterns in their child’s interests and strengths, and surfaces possible careers and activities to explore. Reports are produced by a fixed, rule-based scoring model with pre-written, human-authored insight text; the Service also offers an optional question-and-answer helper that uses third-party AI models.

The Service is NOT:

  • a medical, psychological, psychiatric, diagnostic, or therapeutic service;
  • a substitute for advice from a licensed clinician, teacher, or counsellor;
  • a screening or assessment tool for autism, ADHD, learning differences, mental health conditions, giftedness, IQ, or any other clinical or educational diagnosis;
  • a validated, standardised, or clinically normed psychometric instrument;
  • a guarantee of any career, educational, academic, financial, or life outcome.

No reliance. Results, insight text, career matches, and any AI output are informational and entertainment-oriented material for parent-led conversation only. You agree that you will not rely on the Service as the sole basis for any decision affecting your child’s education, health, wellbeing, or future, and that all such decisions, and their consequences, are yours alone. You accept the risks of using an exploratory tool of this kind. If you have any concern about your child’s development, consult a qualified professional.

3.Who can create an account

Only adults (18+) who are the parent or legal guardian of the child whose information will be entered may create an account. By creating an account you confirm that:

  • you are at least 18 years old;
  • you are the parent or legal guardian of every child profile you add, or have explicit written permission from such a parent or guardian;
  • you consent on behalf of your child to the limited collection and use of their information described in our Privacy Policy.

Children do not create their own accounts. If you choose to let your child use the Service in “supervised” mode under your account, you remain fully responsible for everything they do, see, and enter.

4.Acceptable use

You agree not to:

  • upload information about a child who is not yours, without verifiable parental consent;
  • upload sensitive medical, psychiatric, biometric, financial, or government-ID information;
  • use the Service to harass, bully, or profile others;
  • attempt to reverse-engineer, scrape, or interfere with the Service or its AI models;
  • resell, white-label, or commercially redistribute the Service without a written agreement.

4b.Parent warranty and prohibited inputs

Parent warranty. You represent and warrant that you are the parent or legal guardian of every child whose information you enter, or that you have the documented written authority of such a parent or guardian, and that you have the right to provide that information to us. You agree to indemnify us in full for any claim arising from a breach of this warranty, including claims by another parent, guardian, or authority.

Prohibited inputs. Do not enter health, medical, clinical, diagnostic, therapy, biometric, genetic, immigration, government-identifier, precise-location, financial-account, or password information about yourself or your child, and do not upload photographs of children. The Service is not built to hold that kind of information. We may delete any content entered in breach of this section without notice and without liability, and we may suspend the account that entered it.

Keep entries brief and behavioural (“built a marble run”), not clinical. You are responsible for everything entered under your account.

5.Free and paid plans

The Service offers a free tier and paid subscription plans (“BecArt Plus” and any future tiers). Features included in each plan, and their limits, are described on our pricing page and may change. We will give reasonable notice of material reductions to the free tier.

Paid subscriptions renew automatically each billing period until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current paid period and we do not pro-rate refunds for partial periods, except where required by applicable consumer law.

Prices are shown in the currency displayed at checkout and are exclusive of taxes unless stated. We may change prices with at least 30 days’ notice; price changes apply to subsequent billing periods only.

Merchant of Record. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle’s Buyer Terms in addition to these Terms.

5b.Generative AI: acceptable use and accuracy

The Service uses generative AI to produce suggestions, conversation, and reflections. You agree not to use the Service to generate content that is illegal, hateful, harassing, sexually explicit, defamatory, or that infringes another person’s rights, and not to attempt to jailbreak, bypass, or extract the underlying models or system prompts. You are responsible for what you enter as prompts, for how you use AI output, for verifying its accuracy, and for confirming that you have the rights to any content you input.

AI output may be inaccurate, incomplete, or biased and is not a substitute for professional medical, psychological, educational, legal, or financial advice. We may filter, restrict, or remove AI output and may suspend accounts that repeatedly misuse the Service or infringe third-party rights. If you believe AI output infringes your rights, contact ajatuaewoarthur@live.com with a takedown request.

6.Your content and our content

You keep all rights to the information you enter (child profiles, moments, notes — “Your Content”). You grant us a limited, worldwide licence to host, process, transmit, and display Your Content solely so we can operate the Service for you, including sending it to AI providers as described in the Privacy Policy.

The Service itself, including text, design, code, logos, illustrations, the “FuturePath” methodology and any AI-generated text we publish, is owned by BECART DIGITAL SOLUTIONS, a British Columbia sole proprietorship (BC Registry No. FM1112039, Canada Business Number 703278838BC0001) owned and operated by Arthur Okeoghene Ajatuaewo, offering the BecArt FuturePath service or its licensors. You may use it only through the Service, for your personal, non-commercial use.

7.AI output

Some responses are produced by third-party AI models. We do not warrant that AI output is accurate, complete, appropriate for your child, or free of bias. Do not rely on AI output for medical, educational, legal, or financial decisions.

8.Account suspension and termination

We may suspend or terminate your account, with or without notice, if you breach these Terms, if required by law, or if continued service poses a risk to other users or to the Service. You may close your account at any time; on closure we will delete your data as described in the Privacy Policy.

9.Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, BECART DIGITAL SOLUTIONS, a British Columbia sole proprietorship (BC Registry No. FM1112039, Canada Business Number 703278838BC0001) owned and operated by Arthur Okeoghene Ajatuaewo, offering the BecArt FuturePath service disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.

9b.Availability and third-party material

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We may change, suspend, or discontinue features, run maintenance, or impose limits at any time, with notice where practical. There is no uptime commitment and no service credit for downtime.

Career pages, activity ideas, and other parts of the Service link to third-party websites, videos, and resources that we neither control, review continuously, nor endorse. You are responsible for supervising what your child views. Any dealings with a third party are between you and that third party, and we are not liable for their content, practices, or availability.

10.Limitation of liability

To the maximum extent permitted by law, BECART DIGITAL SOLUTIONS, a British Columbia sole proprietorship (BC Registry No. FM1112039, Canada Business Number 703278838BC0001) owned and operated by Arthur Okeoghene Ajatuaewo, offering the BecArt FuturePath service and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or opportunities, arising out of or relating to your use of the Service, even if advised of the possibility of such damages.

Our total aggregate liability for all claims arising out of or relating to the Service in any 12-month period is limited to the greater of (a) the amounts you actually paid us for the Service in that period, or (b) CAD $50.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability; in those jurisdictions the above applies to the maximum extent permitted by law.

11.Indemnity

You agree to defend, indemnify and hold harmless BECART DIGITAL SOLUTIONS, a British Columbia sole proprietorship (BC Registry No. FM1112039, Canada Business Number 703278838BC0001) owned and operated by Arthur Okeoghene Ajatuaewo, offering the BecArt FuturePath service from any claim, damage, or cost (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) Your Content, or (c) your misuse of the Service.

12.Governing law and disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in that province, without regard to conflict-of-law rules. Disputes will be resolved exclusively in the courts located in British Columbia, Canada, and you consent to that jurisdiction. Nothing in this clause limits any non-waivable consumer rights you have under your local law.

12b.How disputes are handled

Notice first. Before starting any claim, you agree to send us a written description of the dispute and the relief you seek at ajatuaewoarthur@live.com, and to negotiate in good faith for 30 days. Most issues are resolved at this stage.

Individual claims only. To the fullest extent permitted by law, claims must be brought in your individual capacity, not as a plaintiff or class member in any purported class, collective, or representative proceeding, and claims may not be consolidated with those of any other person.

One-year limitation. Any claim arising out of or relating to the Service must be filed within one (1) year after it first arose, or it is permanently barred, except where a longer period is required by applicable law.

Nothing in this section limits any non-waivable consumer rights, including any right to bring a matter before a small claims court or a consumer protection authority in your place of residence.

12c.General

Severability. If any provision is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions stay in force.

Entire agreement. These Terms, the Privacy Policy, the Refund Policy and Paddle’s Buyer Terms are the entire agreement between you and us about the Service, and replace any prior understandings.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not assign or transfer these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets, on notice to you.

Force majeure. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, including outages of hosting, network, payment or model providers, natural events, labour disputes, or government action.

Survival. Sections on no-reliance, prohibited inputs, your content, disclaimers, limitation of liability, indemnity, governing law, disputes and this section survive termination.

13.Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you in-app or by email at least 14 days before it takes effect. Continued use of the Service after the effective date means you accept the updated Terms.
